AFMLS/Attorney General's Organized Crime Council/Organized Crime and Gang Section Financial Investigations Seminar

This practical, innovative, and interactive seminar is designed to enhance the participants' investigative skills while following the money of a criminal enterprise. Through a comprehensive use of a video-based case study, financial documents, lectures, and activities, the seminar will provide the participants an opportunity to apply techniques and strategies to identify and track assets for forfeiture, analyze bank documents and tax records, anticipate legal defenses and determine how to overcome them, and determine which money laundering and RICO statutes have been violated and should be charged. Participants will discuss the case study as a team and will take turns reporting the team's investigative results to the entire group. Modules such as "Proving Unexplained Income," "Obtaining and Analyzing Bank Documents," "BSA Reporting Requirements," "RICO," and "Tracing the Money" will be highlighted. The program level is Intermediate. There are no prerequisites; preparation in advance is not required. Because this seminar is being offered to several law enforcement agencies and the United States Attorneys' Offices, seating is limited.

AFMLS/OCDETF Financial Investigations Seminar

This is a basic seminar. The objective of this seminar is to apply investigative techniques and methods to unravel the case studys money laundering scheme, to identify assets for forfeiture, and to make charging and forfeiture decisions. Using videos to illustrate the case study involving a drug enterprise, this practical, innovative, and interactive seminar is designed to introduce participants to financial investigations, money laundering, and asset forfeiture. During the seminar, participants will analyze financial documents to establish links among the targets, assets, and the illegal activities. This seminar is open only to participants with five years or less experience in financial investigations, asset forfeiture, and money laundering.

Advanced Civil Environmental Enforcement Seminar

This seminar provides advanced instruction on recent developments under the major environmental statutes, including the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA); the Clean Air Act and the Clean Water Act (CWA), including a discussion of the alleged violations of the CWA and Oil Pollution Act in connection with the 2010 explosion of the Deepwater Horizon rig in the Gulf of Mexico. A substantial focus of this years seminar will be on ways to effectively incorporate and implement the goals of Environmental Justice in the outcomes of federal civil environmental enforcement actions, and will include workshops providing instruction in practical skills. Advanced instruction will also be provided on developments in issues related to the intersection of environmental law and bankruptcy practice; issues related to managing e-discovery in civil environmental enforcement actions, and; innovations in the development of remedies, e.g., green infrastructure projects. Familiarity with the federal environmental statutes and previous environmental litigation experience is required for some of the more advanced breakout sessions.

Advanced Joint Civil E-Discovery Training for Civil E-Discovery Coordinators (EDOCs) and EDOC Techs

The National Advocacy Center is hosting three separate training sessions in one week to address many challenges of E-Discovery. [NOTE: The second course is not just for EDOCS/EDOC Techs] The first course, the Advanced Joint Training Course designed exclusively for Civil E-Discovery Office Coordinators (EDOCs) and EDOC Techs. This 2.5 day course will be held December 5-7, 2012 and will cover advanced concepts in E-Discovery including implementing litigation holds in the client agencies; tailoring E-Discovery strategies for cases; developing and implementing search terms; and, several work group discussions on legal and technical issues in E-Discovery. Designated EDOCs and EDOC Techs who did not attend the training at the NAC in May 2012 are encouraged to attend the December Advanced Joint Training. The second course, E-Discovery Challenges for AUSAs in the Average Case, will be held on Monday and Tuesday December 3-4, 2012. This 1.5 day course is open to a limited number of AUSAs (you do not need to be an EDOC to register). USAO EDOC Techs who have been certified to use LAW to process ESI may also register. This course is designed to provide practical training on how to handle E-Discovery in the average USAO defensive case from initial case assignment through preparing for and engaging in discovery, to using electronic documents in motions practice, mediation, settlement negotiations, and trial. The course also includes practical training on how to use technology available to the districts as well as how to work with federal client agencies on E-Discovery matters. The third course is LAW Certification for EDOC Technicians, is also on Monday and Tuesday Dec. 3-4.This two day course has been designed exclusively for EDOC Techs who want to be certified by LEXIS in processing ESI using LAW. This 2-day certification program will be held on Monday and Tuesday December 3-4, 2012. Applicants must pass a rigorous test to be certified.

Advanced Money Laundering Seminar

This seminar is designed for Assistant United States Attorneys (AUSAs) and federal investigative agents with extensive experience in money laundering/asset forfeiture cases and who are actively involved in the investigation and prosecution of these cases. This is an annual seminar designed to provide the latest developments in the law, various panel discussions relating to money laundering issues, and case presentations. AUSAs may nominate an investigating agent who is currently involved or will be involved in money laundering/asset forfeiture investigations. The nominating AUSA should forward the Agent Nomination Form to the agent for completion. Following completion of the form, the agent must return it to the nominating AUSA who should then forward it to Karen Wilson at karen.wilson@usdoj.gov.

Basic Civil Pretrial Practice Seminar

This basic skills course is designed to cover case planning and management from filing to pre-trial conference, with emphasis on discovery, particularly witness preparation and depositions of fact/expert witnesses. The method of instruction includes lecture, instructor demonstrations, and practice exercises performed in small groups of teamed attorneys. Participants will be expected to devote significant time to reviewing case materials and preparing for hands-on exercises. The Basic Pretrial Practice course is an excellent precursor to taking Civil Trial Advocacy and is intended for new civil attorneys with little or no (civil) experience.

Basic International Issues Seminar

This seminar is presented jointly with the National District Attorneys Association and the National Association of Attorneys General. The course is designed for criminal prosecutors in federal, state, and local jurisdictions and will focus on international aspects of the investigation and prosecution of criminal cases including the location and apprehension of fugitives abroad; extradition and other methods for obtaining custody of international fugitives for trial in the United States; locating and obtaining documents, records, items of physical evidence and assets located outside the jurisdiction of the United States; locating and deposing witnesses in foreign jurisdictions; the role of the Department of Justice and the Office of International Affairs when transnational issues arise; how INTERPOL can be effectively utilized; the role of the United States Marshals Service; a review of bilateral treaties and agreements on extradition, mutual legal assistance, and prisoner transfer; utilization of multi-lateral conventions and treaties; consular notification and access; and a basic overview of some critical national security issues that can arise in criminal investigations and prosecutions and that impact the foreign relations and strategic interests of the United States.

Basic Money Laundering Seminar

This seminar is aimed at prosecutors and agents interested in a basic introduction to criminal prosecutions under the currency reporting and currency smuggling statutes, 31 U.S.C. Sec. 5313, 5316, 5324, 5331, and 5332; the traditional money laundering statutes - 18 U.S.C. Sec. 1956 and 1957; and the unlicensed money transmitting business statute - 8 U.S.C. Sec. 1960. Basic RICO/Section 1959 Seminar

This seminar is an introductory course designed for Assistant United States Attorneys in Organized Crime Strike Force Units and other AUSAs and DOJ attorneys who prosecute RICO and Section 1959 cases. It will provide basic instruction in the investigation and prosecution of cases using the RICO (18 U.S.C. Sections ?? 1961-1968) and Violent Crimes in Aid of Racketeering (18 U.S.C. Section ? 1959) statutes. Topics will include using these statutes to combat criminal organizations; investigation and trial strategies; charging and drafting decisions in preparing racketeering indictments; using RICO forfeiture; and preparing for RICO sentencing issues. Guidance will also be provided on criteria for obtaining the required approval from the Organized Crime and Gang Section for RICO indictments, including charging policy and prosecution memoranda. One hour of ethics credit will also be included.

Civil Faculty Instructional Design and Development Seminar

This interactive seminar is designed for instructors with limited (or no) prior teaching experience who want to increase (develop) their effectiveness as instructors. You will be introduced to fundamental principles of adult learning and Instructional Design and their application in teaching and student assessment. Computer Forensics Seminar

We are living in a digital world where computers touch almost every aspect of our lives and subsequently, digital evidence is a critical component of every kind of prosecutions, from the hacking and child pornography to violent crime, organized crime and fraud. The future of prosecutions depends on the ability to identify, extract and analyze digital evidence. This workshop is designed for prosecutors and provides them with the solid foundation of computer forensics. It equips prosecutors with the knowledge to understand the possibilities of computer forensics and gives them the ability to ask the right questions to obtain the specific information they need for prosecutions. Further, it provides demonstrated examples of the types of evidence and information that can be obtained from a computer forensic analysis that will not only provide evidence was on a computer but also how it got there, if it was accessed and in many cases, who is responsible for the activity on the computer (putting fingers on the keyboard). The course will cover areas such as but not limited to the preparation of a warrant for electronic evidence both technical and legal issues, execution of a warrant for electronic evidence, and includes plenty of hands-on demonstrations where prosecutors will experience firsthand how computer forensics is accomplished, what kind and where evidence is located that will help them in their prosecutions. Besides the hands-on portions of the course, prosecutors will also receive the latest legal information on pre trial discovery issues and direct and cross examination of a computer forensics expert witness.

Courtroom Presentations Seminar

This three and a half day course is a basic course designed to familiarize students with the use of currently available Legal Information Technology (LIT) applications in the trial phase of a criminal or civil case. Students selected to attend this course will receive hands-on training on the Sanction II.9 and TimeMap 5, applications. The Sanction II.9 portion of the course will cover creating a case by using the drag and drop method as well as using load files from eScan-IT, LAW PreDiscovery, IPRO, and iConect, creating presentation folders, using the Presentation mode in court, synchronizing audio and video files with a corresponding transcript, making clips of media files, and using the print option. The TimeMap 5 portion of the course will cover how to create a time line in the application as well as creating a time line directly from a CaseMap case. At the conclusion of the course, students complete an individual project which will culminate with a mock trial. Students selected to attend this course will also be required to watch approximately 2-3 hours of on-demand training on PowerPoint 2010 through Lynda.com. We will provide students with the list of required training videos with the course acceptance. The on-demand training will cover creating a basic presentation, animating text, inserting pictures, inserting audio and video files, printing, and presenting the presentation. There will be a short classroom presentation on using PowerPoint 2010 with Sanction II.9 and TimeMap 5. Since this is a basic course, no prior knowledge of the applications covered is required and students should not expect to have mastered the technology by the end of the course. Due to the technical nature of this seminar, no Continuing Legal Education (CLE) credit will be awarded for attending this seminar.

Criminal Appellate Advocacy Seminar

The goal of this seminar is to strengthen brief-writing and oral argument skills. The course will consist of class lectures, brief-writing exercises that will focus on specific parts of an appellate brief, oral arguments, and videotaped oral arguments with faculty critiques of those arguments. For the brief writing portion of the course, each attendee will be expected to have read the materials (appellant's brief, appellee's brief, case law and excerpt of record)prior to arrival. Also prior to arrival, each attendee must prepare the opening paragraph of the summary of the argument section for the government's brief and bring that summary with them to the course. For the oral argument portion of the course, the attendee will be required to participate in three mock oral arguments before faculty and a circuit judge. While the course is open to all criminal attorneys, Criminal Assistant United States Attorneys will be given first priority for attendance.

Criminal Discovery for Support Staff Seminar

This three day course will be an overview of the various discovery-related issues that may arise in a criminal case, including Brady, Giglio, the Jencks Act, and Rule 16. The impact of electronic discovery on criminal practice will also be addressed. The course is designed to train support staff working in the criminal sections of the United States Attorneys' Offices so that they will be better able to assist prosecutors and law enforcement agents in fulfilling the Government's disclosure obligations in criminal cases. In addition, the course will address the use of case management software programs designed to assist in the investigative, charging, discovery, and trial stages of criminal cases.

Debt Collection for Agency Personnel Seminar

This seminar is designed to train non-DOJ agency attorneys and program personnel responsible for debt collection on the remedies available to assist in the collection of debts owed to the United States. The seminar will cover topics related to the recovery of moneys owed the U.S. including responsibilities and authorities under the Debt Collection Improvement Act of 1996, the Federal Debt Collection Procedures Act, and other laws; the roles of the Department of Justice and the Department of the Treasury; litigation-related topics such as completing the Collection Claims Litigation Report for referring debts for enforced collection, investigating assets, reading financial statements, and bankruptcy issues; and the administrative actions the Department of the Treasury will take to collect debts such as administrative wage garnishment, offset of federal payments, and referral to private collection agencies. Defending Childhood: Protect, Heal, Thrive

Studies suggest that sixty percent of American children have been exposed to violence, crime or abuse in their homes, schools and communities. The Attorney Generals Defending Childhood Initiative is designed to develop comprehensive community-based strategic planning and implementation to prevent and reduce the impact of childrens exposure to violence in their homes, schools, and communities. This training will provide substantive information on the causes and characteristics of childhood exposure to violence and also skill building exercises on implementing organizational and systemic changes that promote improvements in systems and services in the area of childrens exposure to violence. Discovery Boot Camp for New Prosecutors

The training is limited to criminal attorneys in the Department's Litigating Divisions only. This course is designed to comply with the mandate of discovery training for new prosecutors that requires all new federal prosecutors assigned to criminal cases to complete in their first twelve months of employment training on Brady, Giglio and other DOJ disclosure obligations and policies. The course will focus on a variety of discovery-related issues, including Brady; Giglio; Rule 16; Jencks; electronically stored information (ESI) in criminal cases; DOJ guidance on disclosure of electronic communications and other ESI; and commonly encountered discovery issues, such as agent and attorney notes. Faculty will provide substantive information through lectures and discussion of a series of hypothetical scenarios. Smaller breakout sessions also will be held to give students the opportunity to apply the information learned to a hypothetical case. At the conclusion of the course, students will be familiar with the guiding legal principles and Department policies regarding disclosure obligations in criminal cases and will be able to apply those principles and policies to their own criminal cases.

This three and one-half day course deals with using computer technology to electronically capture, store, and view documentary evidence in civil or criminal cases. The emphasis of this course is on using LAW PreDiscovery software to capture documentary evidence and generate electronic copies. Electronic Evidence and Basic Cybercrime Seminar

Criminal investigations of all types can now involve electronic evidence. Electronic evidence can take many forms, such as data taken from a suspect's hard drive, e-mail obtained from a service provider, or cell phone location information. The materials in this course are useful for prosecuting crimes as diverse as terrorism, drug offenses, health care fraud, and gang offenses. This is a basic seminar for prosecutors. Students will be introduced to concepts in obtaining online evidence, such as e-mail, the search and seizure of computers, and the investigation and prosecution of computer-related crimes. The Computer Crimes and Intellectual Property Section of the Criminal Division is organizing this course, and will staff many of its lectures. Environmental Crimes Seminar

The first day of this seminar will be optional. That day will be dedicated to basic pollution and wildlife crimes topics, including the major statutes under which most pollution and wildlife violations are prosecuted. Identity Theft Seminar

This two-and-a-half day seminar is designed for all criminal attorneys who handle investigations and prosecutions related to identity theft. The course will include basic sessions providing an overview of identity theft, discussion of the applicable statutes and charging decisions, and a general discussion of investigative techniques. The course will provide a practical, case-study based interactive learning experience, beginning with case referral, statutory considerations, investigative hurdles, valuation issues, ethical issues in working with victims, and other practical prosecutorial considerations. This course will also feature a hands-on lecture and demonstration in conducting online reconnaissance to identify subjects, co-conspirators and other known associates of your investigation, considerations for setting up and managing online undercover operations and examples of inforamtion prosecutors can ask for and expect when requesting computer forensic examinations. At the conclusion of this course, students will have practical knowledge of the different theories and types that can be used to investigate and prosecute intellectual property crimes. They will also gain sufficient knowledge to take an informed and active role when using computers to gather evidence for intellectual property offenses, though total technical proficiency is not expected.

Intermediate CDCS Training

Motion Practice and Brief Writing for Civil Attorneys Seminar

This Motion Practice and Brief Writing Seminar covers dispositive and non-dispositive motions, with a particular focus on summary judgment. Topics include: motion planning, strategic considerations in filing motions, effective structure and organization, constructing artful declarations, statements of fact, reply brief strategy and oral argument as well as systematic approaches to summary judgment in Title VII and FTCA cases. Model case materials utilized in this seminar are premised upon Title VII and FTCA actions. The method of instruction includes lecture, independent study and practicums. Each student will be expected to submit a current writing sample, one month in advance of the course, for faculty review and individual editing assistance. Participants will also be expected to review model case materials and draft portions of motions prior to arriving at the NAC.
