President Of Florida Employer Solutions, Inc. Sentenced To Two Years In Federal Prison

July 12, 2012

Orlando, FL - U.S. District Judge Charlene Edwards Honeywell sentenced Luis Armando Ferrer (40, Pembroke Pines) today to two years in federal prison for failure to account for and pay FICA and Income Tax. Ferrer pled guilty on February 29, 2012. The Court also ordered Ferrer to pay restitution in the amount of $640,707.79.

According to court documents, Ferrer was the President of Florida Employer Solutions, Inc. (FES). FES’s business included performing payroll services for client companies and agreeing to collect, account for, and pay over social security, medicare taxes, and federal incomes taxes to the Internal Revenue Service on behalf of those companies. Ferrer was responsible for collecting, accounting for, and paying over to the IRS the employees’ share of FICA taxes and federal income taxes for these companies.

Instead of paying this money over to lRS, Ferrer diverted it to his own personal bank account. He used it, in part, to pay to start up a landscaping business, Florida Outdoor lmpressions, lnc. (FOl).

This case was investigated by the Internal Revenue Service Criminal Investigation. It was prosecuted by Assistant United States Attorney Christopher LaForgia and Bruce Amrbose.
