SETTLEMENT REACHED IN TRUMAN ANNEX CIVIL CASE

FOR IMMEDIATE RELEASE
Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida, announced that a settlement was reached in United States v. Truman Annex Master Property Owners Association (TAMPOA), Case No. 09-09-10023-CIV-MARTINEZ.
On February 18, 2009, the United States filed a civil complaint seeking an emergency restraining order against TAMPOA from restricting the Government's access to its Southard Street easement and its military installations at Truman Annex. The United States sought an injunction to stop TAMPOA's proposed construction of gates and fences on Southard Street, which would present substantial security and safety hazards and adversely affect the daily functions of military operations at Naval Air Station Key West, including Truman Annex. Southard Street is the main entrance to the U.S. Naval Station Key West ("NAS Key West") at Truman Annex.
On February 19, 2009, U.S. District Court Judge Jose E. Martinez issued a temporary restraining order against TAMPOA, ordering that road construction work cease immediately on Southard Street. In the settlement filed today, TAMPOA has agreed to be permanently enjoined from interfering or restricting in any way with the United States' right to use its Southard Street easement through TAMPOA's property.
The U.S. Attorney's Office represented NAS Key West, the Joint Interagency Task Force South ("JIATF"), and the National Oceanic and Atmospheric Administration ("NOAA"), all of which maintain facilities at Truman Annex. This case was handled by Assistant U.S. Attorneys Grisel Alonso and Anthony Pogorzelski.
