DEFENDANTS SENTENCED TO JAIL TERM FOR HUNTING MIGRATORY BIRDS IN EXCESS OF DAILY BAG LIMIT

Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida, and Eddie McKissick, Resident Agent in Charge, U.S. Fish and Wildlife Service, announced that defendants Alain De La Cruz Martin, 40, and Orlando Gorgoy, 29, both of Miami, FL, were sentenced today by U.S. Magistrate Judge Ann E. Vitunac to a term of incarceration for the taking of migratory birds in excess of the daily bag limit, in violation of Title 16, United States Code, §703 and 50 C.F.R.§20.24.
Defendants De La Cruz and Gorgoy had hunted waterfowl and shot more than the daily limit. In imposing sentence, Magistrate Judge Vitunac noted that in addition to shooting more than the daily limit, the defendants had left several ducks wounded to die in the water.
Defendant Alain De La Cruz Martin was sentenced to thirty days incarceration, a $500 fine, two years probation, a prohibition from hunting during the period of probation, and the forfeiture of a shotgun used in the offense.
Defendant Orlando Gorgoy was sentenced to one weekend in jail, a $500 fine, two years probation, a prohibition from hunting during the period of probation, 50 hours of community service, and the forfeiture of a shotgun used in the offense. Additionally, the defendant agreed to abandon two other weapons to the U.S. Fish and Wildlife Service.
Mr. Sloman commended the investigative efforts of the U.S. Fish and Wildlife Service and the Florida Fish and Wildlife Conservation Commission. The case was handled by Assistant U.S. Attorney Kerry Baron.
