TWO FORMER SPIRIT AIRLINES EMPLOYEES AND TRAVEL AGENT PLEAD GUILTY TO COMPUTER FRAUD

FOR IMMEDIATE RELEASE

Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida, and Michael K. Fithen, Special Agent in Charge, United States Secret Service, Miami Field Office, announced that defendants Fior Davila, 36, of Pembroke Pines, FL, Orlando Reyes, 39, of Fort Lauderdale, FL, and Luisa Berges, 52, of Boca Raton, FL, pled guilty today before U.S. District Court Judge William P. Dimitrouleas to charges of computer fraud, in violation of Title 18, United States Code, Section 1030(a)(4).

Sentencing has been scheduled for September 16, 2009, at 1:15 p.m., 1:30 p.m., and 1:45 p.m., for Davila, Reyes, and Berges, respectively. At sentencing, each defendant faces a maximum of up to 5 years' imprisonment, a term of supervised release of up to 3 years, and a possible fine.

According to in-court statements and pleadings filed with the Court, defendants Davila and Reyes were former employees of Spirit Airlines. Defendant Berges was a private travel agent. In 2007, both Davila and Reyes knowingly exceeded their authorized access to Spirit’s computer system, with the intent of defrauding the airline. By exceeding their authorized access to Spirit’s computer system, Davila and Reyes obtained airline tickets and vouchers that did not belong to them. Davila and Reyes provided the tickets and vouchers to defendant Berges, who resold these through her travel agency to unsuspecting customers.

Mr. Sloman commended the investigative efforts of the U.S. Secret Service. In addition, Mr. Sloman thanked Spirit Airlines for their cooperation in this investigation. The case is being prosecuted by Assistant U.S. Attorney Randy Katz.
