KROME DETAINEE SENTENCED FOR ASSAULT ON GUARD

FOR IMMEDIATE RELEASE

Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida, and Michael Rozos, Field Office Director, U.S. Immigration and Customs Enforcement (ICE), Office of Detention and Removal, Miami Field Office, announced that defendant Saingelus Saingerard was sentenced on Friday, August 28, 2009, by U.S. District Judge Jose E. Martinez.

Saingerard was sentenced to 135 months’ imprisonment, to be followed by 3 years of supervised release. Defendant Saingerard had previously been convicted at trial of assaulting a contract custody officer at the Krome Processing Center, in violation of 18 U.S.C. § 111(b).

According to testimony at trial, Saingerard assaulted the officer by biting the officer’s hand while Saingerard was being led to the general housing unit. During the assault, Saingerard severed the tip of the officer’s finger. While Saingerard was in custody awaiting trial and sentencing, he repeatedly caused disruptions in Court. At sentencing, the court imposed an enhancement under the Federal Sentencing Guidelines for obstruction of justice due to the Saingerard’s disruptive behavior leading up to trial.

Mr. Sloman commended the investigative efforts of ICE’s Office of Detention and Removal. Mr. Sloman also commended the U.S. Marshals Service and the Bureau of Prisons for their assistance in handling the defendant during trial. This case is being prosecuted by Assistant U.S. Attorneys Derek Bentsen and Cristina Perez Soto.
