CONVICTED CUBAN SPY RE-SENTENCED TO 262 MONTHS INCARCERATION

Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida, announced that United States District Judge Joan A. Lenard today sentenced Antonio Guerrero to 262 months in prison for conspiracy to commit espionage, in violation of Title 18 United States Code, Section 794(c). The matter was before the court on remand from the Eleventh Circuit Court of Appeals, which had ruled that the previous sentence of life in prison was improper.

In 2000-2001, Guerrero was one of five defendants convicted at trial of being clandestine agents and officers in service to the Government of Cuba’s Directorate of Intelligence. Guerrero penetrated the Boca Chica Naval Air Station at Key West where he was working to obtain classified information for transmission to the Cuban government. Guerrero did not succeed in obtaining top secret information.

Two co-defendants are scheduled to be re-sentenced at a later date. The sentences of two other co-defendants were affirmed on appeal by the Eleventh Circuit.

“Today’s sentence reflects the court’s concern at the severity of the crime for which a jury found the defendant guilty of beyond any reasonable doubt,” said Jeffrey H. Sloman, Acting United States Attorney for the Southern District of Florida.

This case is being prosecuted by AUSAs Caroline Heck Miller and Michael Sherwin.
