PRESS RELEASE

Macon: Max Wood, the United States Attorney for the Middle District of Georgia announced today that on November 6, 2008, SAMMY A. CAVES , was sentenced before the Honorable Clay D. Land, United Sates Judge for the Middle District of Georgia, sitting in Columbus, Georgia.

On May 14, 2008, CAVES entered a guilty plea to one count of concealment of assets belonging to the bankruptcy estate of a debtor, in violation of Title 18, United States Code, Section 152(1).

CAVES is an orthodontist in Columbus, Georgia. On June 17, 2003, CAVES filed a Chapter Eleven Bankruptcy case in the United States Bankruptcy Court for the Middle District of Georgia. His petition was filed under oath. CAVES failed to list all of his assets in his petition and subsequently sought to conceal the assets from his creditors, as well as the United States Trustee. In his petition, CAVES failed to disclose eighteen (18) firearms and a gun safe with a liquidation value of approximately $8,450.00. In addition, CAVES failed to disclose a gold Rolex Presidential watch with an insurance value of $18,792.00. Said watch was discovered on the defendant’s wrist during a creditor’s meeting.

CAVES received a sentence of five (5) years probation, and is required to serve 180 days of home confinement with electronic monitoring. The defendant was ordered to pay a $5,000.00 fine. In addition as a condition of his sentence, CAVES was ordered to provide free dental care to indigents for a value of $50,000.00.

The charges against CAVES arose from a referral by the Office of the United States Trustee, and an investigation conducted by the Federal Bureau of Investigation. The prosecution was handled by Assistant United States Attorney Harry J. Fox, Jr.
