Gun Defendants Sentenced

MACON:  Maxwell Wood, United States Attorney announced that Benjamin Finney, Marlon Jackson and Bobby Mack were sentenced today before the Honorable Hugh Lawson, United States District Judge for the Middle District of Georgia.  Finney was sentenced to 70 months (5 years, 10 months) without the possibility of parole followed by three years of supervised release.

Jackson was sentenced to 28 months without the possibility of parole followed by three years of supervised release.  Mack was sentenced to 3 years probation.

In October, 2008, Jackson and Mack entered guilty pleas to aiding and abetting Finney’s possession of a firearm by convicted felon in violation of Title 18, United States Code, Sections 922(g)(1) and Section 2.  Jackson and Mack aided Finney in possessing an AR-15 assault type rifle with a high capacity 30 rounds of ammunition magazine.

In November, 2008, Finney entered a guilty plea to Possession of a Firearm by a Convicted Felon and Possession of Cocaine.  In addition to the AR-15, Finney admitted to the possession of two Glock pistols.  Each Glock pistol had a high capacity 30 rounds of ammunition magazine.

U.S. Attorney for the Middle District of Georgia Maxwell Wood stated that: “With the six year anniversary of the Department of Justice’s Project Safe Neighborhoods Violent Crime and Illegal Possession of Firearms Initiative fast approaching, every felon needs to be reminded that the U.S. Attorney’s Office maintains a “zero tolerance” for felons who possess firearms.  This “zero tolerance” applies not only to convicted felons, but also to anyone who helps felons possess firearms or acquire firearms.  They will be prosecuted in the federal system to ensure that our community remains safe.”

The case as investigated by the Macon Police Department, Jones County Sheriff’s Office and  Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).  The case was prosecuted by Assistant United States Attorney Michael Solis.
