DERRICK JACKSON SENTENCED
 FALSE CLAIMS AGAINST THE GOVERNMENT

Macon:  G. F. Peterman, III, Acting United States Attorney for the Middle District of Georgia announced that on September 9, 2009, DERRICK BERNARD JACKSON was sentenced before the Honorable C. Ashley Royal, United Sates District Court Judge for the Middle District of Georgia.  On May 7, 2007, JACKSON entered a guilty plea to one count of making false claims against the government in violation of Title 18, United States Code, Section 287.  JACKSON received a sentence of forty-two (42) months imprisonment, to be followed by three (3) years of supervised release, and ordered to pay restitution in the amount of $78,752.63.  There is no parole in the Federal System. 

JACKSON held himself out to the public as a tax preparer, and conducted his business at different locations, and under different company names.  JACKSON would falsely represent to the Internal Revenue Service that the information contained in tax returns for various taxpayers was accurate, when in fact the information was false.  Such false information included representations of fictitious employment.  From on or about November 19, 2003, through on or about July 24, 2005, JACKSON did make and present to the Internal Revenue Service fifteen (15) claims, knowing that such claims were false, fictitious and fraudulent when filed, by preparing, and causing to be prepared, U.S. Individual Income Tax Returns, Forms 1040 and 1040X, wherein the defendant claimed tax refunds in an amount to which the named taxpayers were not entitled, that is, $106,165.00.

The charges against JACKSON arose from an investigation conducted by the Internal Revenue Service – Criminal Investigation Division, Treasury Inspector General for Tax Administration, United States ecret Service, the Jones County Sheriff’s office, and the Baldwin County Sheriff’s Office.  The prosecution was handled by Assistant United States Attorney Harry J. Fox, Jr.
