Mexican National Sentenced on Immigration Charges

Des Moines, IA--On January 9, 2008, Juan Jose Rincon-Nieto, 40, was sentenced to 57 months imprisonment following his earlier guilty plea to one count of unlawful entry after deportation subsequent to a conviction for an aggravated felony, announced United States Attorney Matthew G. Whitaker. United States Chief District Judge Robert W. Pratt also ordered Rincon-Nieto to serve a three-year term of supervised release following his incarceration, with the requirement that, if deported, he not reenter the United States without permission, and to pay a $100 assessment to the Crime Victim Fund.

Rincon-Nieto was arrested by the Des Moines, Iowa, Police Department on an unrelated charge on March 10, 2006, and it was subsequently determined that he had previously been convicted of an aggravated felony and thereafter deported. In imposing sentence, Judge Pratt observed that a 57-month sentence was necessary to protect the public and pointed out, among other things, the defendant’s previous criminal convictions, which included crimes of domestic violence.

This investigation was conducted by the Bureau of Immigration and Customs Enforcement and followed defendant’s earlier arrest by the Des Moines, Iowa, Police Department.
