Burlington Woman Sentenced On Federal Drug Charges

DAVENPORT, IA - On January 28, 2008, Nateshia Arnell Davis, age 24, formerly of Burlington, Iowa was sentenced by United States District Court Judge John A. Jarvey to 90 months in federal prison, announced United States Attorney Matthew G. Whitaker. Davis pled guilty to conspiracy to distribute crack cocaine. There is no parole in the federal system. Davis was also assessed $100 to The Crime Victim Fund and after release from prison, Davis will be subject to 5 years of supervised release.
Nateshia Davis pled guilty to being a member of a conspiracy to distribute crack cocaine from April 30, 2006 to May 18, 2006. Her co-conspirator, Timothy Johnson, also known as “Mack,” pled guilty to drug conspiracy charges on June 25, 2007.


On May 18, 2006, Davis distributed approximately 3 grams of crack cocaine to another person in the Family Video parking lot in Burlington, Iowa. Davis admitted knowledge that she was distributing a controlled substance. On May 18, 2006, after the conclusion of the drug transaction, two law enforcement officers identified themselves and approached Davis’s vehicle. Davis drove out of the parking lot, requiring the officers to jump out of the way to avoid being hit, and fled.


Davis, being pursued by individuals she knew as law enforcement officers, drove at a high rate of speed through the city limits of Burlington. Davis reached speeds in excess of 80 miles per hour in an attempt to distance herself from law enforcement vehicles. While attempting to flee, Davis crashed her vehicle into a tree located in the yard of another Burlington residence.


At her sentencing hearing, Davis agreed that she recklessly created a substantial risk of death or serious bodily injury to another person during the course of fleeing from law enforcement.


After Davis was arrested, law enforcement agents executed a search warrant at Davis’s residence in Burlington. Agents seized several items including a plastic bag containing 20 individually packaged baggies of cocaine base. A subsequent lab analysis of this substance determined it was cocaine base with a total weight in excess of 50 grams.
Davis admitted that she knew that crack cocaine was present in her residence, had access and control over the residence and as a result constructively possessed the crack cocaine seized. Also, Davis admitted that she agreed to distribute the crack cocaine for Timothy Johnson, also known as “Mack”. Davis described getting the crack cocaine from Johnson, distributing the drugs as directed by Johnson, returning and giving the money from the transaction to Johnson.


This case was prosecuted in the United States Attorney’s Office in the Southern District of Iowa. This investigation was conducted by the Iowa Department of Public Safety, Division of Narcotics Enforcement, the Southeast Iowa Narcotics Task Force, the Burlington Police Department, the Des Moines County Sheriff’s Office, the Iowa State Patrol, and the Des Moines County Attorney’s Office.
