Rock Island Man Sentenced to 5 Additional Years in Connection with April 2006 Murder

Davenport, IA - On April 1, 2008, Jermil Miller, age 28, of Rock Island, IL, was sentenced by United States District Judge John A. Jarvey to 5 years imprisonment, said term to be served consecutively to his 20-year sentence for murder, previously imposed by the Rock Island, IL, Circuit Court, announced United States Attorney Matthew G. Whitaker. This was the maximum sentence the Court was authorized to impose.

In May 2000, Miller was convicted of drug trafficking in the United States District Court, Southern District of Iowa. In October 2005, after release from federal prison, Miller began a term of supervised release under the supervision of the United States Probation Office. On April 19, 2006, Miller shot and killed Andrell Hearn during a street fight in Rock Island. He pleaded guilty to 2nd degree murder in Rock Island County Circuit Court in August 2006. Miller was sentenced to 20 years imprisonment for that crime.

By committing the murder, Miller not only violated Illinois law he violated the terms of his federal supervised release. Accordingly, a petition to revoke his release was filed. At the revocation hearing on April 1, 2008, the Rock Island Police Detective in charge of the murder investigation testified about the shooting, indicating that Miller shot Hearn as he fled the scene of the fight. Judge Jarvey found that the murder constituted a violation of the terms of Miller’s supervised release and imposed the maximum 5-year. Judge Jarvey also ordered that the federal sentence be served only after completion of the Illinois one.

This case was prosecuted by the United States Attorney for the Southern District of Iowa and investigated by the Rock Island Police Department and United States Probation Office.
