Man Sentenced As Armed Career Criminal In Davenport Federal Court

DAVENPORT- On May 2, 2008, Ricky Lee Kearney, age 46, formerly of Rock Island, Illinois was sentenced by United States District Court Judge John A. Jarvey to 210 months in federal prison, announced United States Attorney Matthew G. Whitaker. Kearney was sentenced after pleading guilty to being a felon in possession of a firearm. Kearney received a enhanced sentence based on a finding that he was an Armed Career Criminal under federal law. There is no parole in the federal system. After release from prison, Kearney will be subject to three years of supervised release. At the time of sentencing, Kearney was already serving a 15 year Iowa state sentence after pleading guilty to theft second degree and two counts of burglary in the third degree.


On January 25, 2007, officers with the Davenport Police Department responded to a reported residential burglary at a residence in Davenport. When officers arrived to investigate the suspect was not present. Officers continued the investigation by driving around the neighborhood when they observed a subject on a bicycle, wearing dark clothing and carrying a bag. As officers approached the subject to speak with him, the subject took off running. Officers chased and caught the subject behind one of the residences. This subject was identified as Ricky Lee Kearney. Officers later recovered a .38 caliber handgun discarded by Kearney during the chase. Kearney was also found in possession of stolen property.

This case was prosecuted in the United States Attorney’s Office in the Southern District of Iowa pursuant to the Project Safe Neighborhoods initiative. This investigation was conducted by the Bureau of Alcohol, Tobacco and Firearms, the Davenport Police Department and the Scott County Attorney’s Office.
