
SHOTS FIRED AT PARTY RESULT IN FEDERAL PRISON TIME FOR O’FALLON MAN
Stephen R. Wigginton, United States Attorney for the Southern District of Illinois, announced today that on April 1, 2011, Michael L. Smith, Jr. 25, of O’Fallon, Ill.-, was sentenced in federal district court in East St. Louis to 24 months’ imprisonment, 3 years’ supervised release, a $100 special assessment, and a fine of $200 following his plea of guilty to a one-count Indictment charging him with Possession of a Firearm by a Convicted Felon.
A Stipulation of Facts filed with the Court states that on July 27, 2010, at the DeShields Housing Projects in East St. Louis, Smith knowingly possessed a firearm and discharged said firearm into the air approximately three times while partying at a birthday celebration for a friend of his. There were no intended or actual victims of the shots fired.
The case was prosecuted by Assistant United States Attorney Stephen B. Clark.
