JERSEYVILLE WOMAN INDICTED ON CHARGES RELATED TO HEROIN OVERDOSE DEATH
A. Courtney Cox, United States Attorney for the Southern District of Illinois, announced today that JAMIE E. DAY, age 25, of Jerseyville, Illinois, has been indicted in a single count indictment charging her with Distribution of a Controlled Substance Resulting in Death.
According to the indictment, on June 8, 2009, DAY distributed heroin to Kelby W. Willman, who died as a result of ingesting the drug. Willman, also of Jerseyville, was 23 years old when he died.
An indictment is a formal charge against a defendant and is not evidence of guilt. Under the law, a defendant is presumed to be innocent of a charge and is entitled to a fair trial at which the Government must prove guilt beyond a reasonable doubt.
If convicted, DAY faces a sentence of between 20 years and life imprisonment, a fine of up to $1 million, and at least three years of supervised release, to be served following any term of incarceration. The investigation which resulted in DAY’S indictment was conducted by the Jerseyville Police Department and the Drug Enforcement Administration. The case is assigned to Assistant United States Attorney Robert L. Garrison for prosecution.
