FEDERAL GRAND JURY IN FORT WAYNE RETURNS INDICTMENTS

Fort Wayne, IN—The United States Attorney's Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following Indictments on November 15, 2006:

JOHN DOE, a/k/a Adaberto Guzman, a/k/a Juaquin Tapia, age 54, of Brownsville, Texas, ANDRES CUELLAR-CHAVEZ, age 44, and ENEDEO RODRIGUEZ, JR., age 26, of Warsaw, IN were charged in one count of a two count Indictment with conspiracy to possess with intent to distribute a controlled substance on October 18, 2006. JOSE RAMIREZ, age 57, of Fort Wayne, IN and JOSE HERNANDEZ, age 41 were charged in with conspiracy to possess with intent to distribute a controlled substance on October 18, 2006, as well as possession with intent to distribute a controlled substance. This charge was filed as the result of an investigation by the Immigration and Customs Enforcement, Drug Enforcement Administration and the Indiana State Police. This case has been assigned to and will be prosecuted by Assistant United States Attorney Tina L. Nommay, who can be reached at 260-422-2595 for any inquiries.

HECTOR M. LOPEZ, age 24, of Ligonier, Indiana, ROMAN A. TORRES, age 27, of Syracuse, Indiana, ALDO PEREZ, age 26, of Lincoln Park, Michigan, MIGUEL A. CARDOZA, age 26, of San Benito, TX 78586, were charged in with conspiracy to possess with intent to distribute a controlled substance from on or about October 16, 2006, and continuing until on or about October 23, 2006. In addition, defendants LOPEZ, TORRES AND PEREZ, were charged with possession with intent to distribute a controlled substance on October 23, 2006. This charge was filed as the result of an investigation by the Drug Enforcement Administration, Fort Wayne Police Department, Allen County Sheriff’s Department, Noble County Sheriff’s Department, IMAGE Drug Task Force and Northeast Indiana SWAT. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller, who can be reached at 260422-2595 for any inquiries.

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
