Hammond, IN—The United States Attorney's Office announced that a Grand Jury sitting in Hammond, Indiana, returned the following Indictments on November 7, 2007:
FERNANDO SANZ, age 33, of Phoenix, Arizona, was charged in a 1 count indictment with illegally re-entering the United States after having been deported from Nogales, Arizona in 2001 and 2002. The defendant has previously been sentenced by Judge Philip Simon in June, 2007, to 262 months of imprisonment for possession with the intent to distribute methamphetamine.
This case is being investigated by Immigration and Customs Enforcement. This case has been assigned to and will be prosecuted by Assistant United States Attorney Thomas S. Ratcliffe.
JOSEPH OLEJNIK, of Hammond, Indiana, was charged in a 1 count indictment with Obstruction of the Mail. Olejnik, an employee of the United States Postal Service, did willfully obstruct and retard the passage of the mail in that he retained in his vehicle a quantity of first class letters and parcels rather than deliver them as required.
This case is being investigated by the United States Postal Service. This case has been assigned to and will be prosecuted by Assistant United States Attorney Bernard Van Wormer.
JERMAINE FAUST, 33, of Matteson, Illinois, was charged in a 1count indictment with, having been convicted of Armed Robbery in 2003, with being a Felon in Possession of a Firearm, to wit: a Smit & Wesson, Model 14, .38 special caliber revolver loaded with six rounds of ammunition. Upon conviction, Faust will forfeit all firearms and ammunition involved in the commission of the offense.
This case is being investigated by the Bureau of Alcohol, Tobacco, Firearms/HIDTA Task Force and the Hammond Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Dean R. Lanter.
The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
The United States Attorney's Office emphasized that these indictments are merely allegations and that all persons charged are presumed innocent until and unless proven guilty in court.
