ACTIVITY IN FEDERAL COURT - FORT WAYNE
Fort Wayne, IN—The United States Attorney's Office announced the following activity in federal court:
Willie McBride, a/k/a Willie Davis, 23, of Chicago, Illinois was sentenced on 4/16/10 by Judge Theresa Springmann to 10 years imprisonment and 5 years of supervised release after pleading guilty to possession with the intent to distribute cocaine base (“crack” cocaine); and to carrying a firearm during and in relation to a drug trafficking crime. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives and the Allen County Sheriff’s Department, and was prosecuted by Assistant United States Attorney Tina Nommay.
David Ingmire, 23, of Fort Wayne, Indiana, was sentenced on 4/16/10 by Judge Theresa Springmann to 63 months imprisonment and 3 years of supervised release after pleading guilty to being a felon in possession of a firearm, having been convicted previously of operating while intoxicated in Allen County in 2007. At the time of his arrest, Mr. Ingmire was in possession of the following firearms and ammunition: Rock River Arms rifle, model LAR-15, 5.56 mm, with a magazine and ammunition; Stevens rifle, model 15, .22 caliber; Smith & Wesson handgun, model 39-2, 9mm handgun, with a magazine and 7 rounds of ammunition; Taurus handgun, model PT24/7 Pro DS, .40 caliber, with a magazine and 9 rounds of ammunition; HS Produkt (IM Metal) handgun, imported by Springfield, Inc., model XD-45, .45 caliber, with two magazines and 14 rounds of ammunition; Remington shotgun, model 870 Police Magnum, 12 gauge; Remington shotgun, model 870 Wingmaster, 12 gauge; four boxes (50 rounds each) of ammunition (one box of .45 caliber, one box of .40 caliber, and two boxes of 9mm); 480 rounds of .223 ammunition; and all other rounds of ammunition. Ingmire was convicted of operating while intoxicated in Allen County in 2007. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives and the Fort Wayne Police Department, and was prosecuted by Assistant United States Attorney Anthony Geller.
Bryan Schlabach, 38, of Topeka, Indiana, plead guilty without benefit of a plea agreement on 4/16/10 before Judge Theresa Springmann to distribution of a visual depiction involving the use of a minor engaging in sexually explicit conduct; receipt of a visual depiction involving the use of a minor engaging in sexually explicit conduct; and possession/accessing with intent to view visual depictions involving the use of a minor engaging in sexually explicit conduct which had been transported in interstate commerce. Sentencing has been set for July 16, 2010. This case was investigated by the Federal Bureau of Investigation and the Queensland, Australia Police Department, and is being prosecuted by Assistant United States Attorney Lesley Miller Lowery.
The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
