South Bend, IN—The United States Attorney's Office announced:Andre Forbes, 27, of Mishawaka, Indiana, was sentenced on 4/22/10 by Judge Robert Miller, Jr., to 93 months imprisonment and 6 years of supervised release after pleading guilty to possession of crack cocaine with intent to distribute, and possession of a firearm in furtherance of a drug trafficking crime. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives and the South Bend Police Department, and was prosecuted by Assistant United States Attorney Donald Schmid.

Sammuel Thomas, 21, of South Bend, Indiana, plead guilty on 4/22/10 before Magistrate Judge Christopher Nuechterlein to possession of a firearm as a drug user. Thomas admitted in a plea agreement that in September 2009 he was a regular user of marijuana and that he possessed several firearms, specifically, a Winchester, shotgun, Model 12, 12 gauge; and a Glock, pistol, Model 27, .40 caliber. Sentencing is set for July 13, 2010. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and was prosecuted by Assistant United States Attorney Donald Schmid.

Benjamin Minnick, 23, of Mishawaka, Indiana, plead guilty on 4/22/10 before Magistrate Judge Christopher Nuechterlein to possession of a stolen firearm, and possession of a firearm as a drug user. Minnick admitted in a plea agreement that he stole a firearm from his grandmother in early September 2009, to wit; an Iver Johnson, pistol, Model TP22, .22 caliber, and that he was a regular user of marijuana. Sentencing has been set for July 12, 2010. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and was prosecuted by Assistant United States Attorney Donald Schmid.

Robert Knisley, Jr., 27, of Mishawaka, Indiana, plead guilty on 4/23/10 before Magistrate Judge Christopher Nuechterlein to possession of a firearm as a drug user. Knisley admitted in a plea agreement that he possessed a Harrington & Richardson, shotgun, Model Pardner, 12 gauge, from October 2007 until the Spring of 2009. During this 2007-2009 time period, he was a regular user of marijuana. Sentencing has been set for July 19. 2010. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and was prosecuted by Assistant United States Attorney Donald Schmid.

 

Shane Hatter, 30, of Plymouth, Indiana, was sentenced on 4/23/10 by Judge Robert Miller, Jr. to 63 months imprisonment and 3 years of supervised release after pleading guilty to being a felon in possession of a firearm, to wit; a Marlin .22 cal rifle. This case was investigated by the Bureau of Alcohol, Firearms, Tobacco, and Explosives, and was prosecuted by Assistant United States Attorney Frank Schaffer.

 

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
