FEDERAL GRAND JURY IN FORT WAYNE RETURNS INDICTMENTS


Fort Wayne, IN—The United States Attorney's Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following Indictments on December 15, 2010:

 

Rodrigo Cerrato, 42, of Fort Wayne, Indiana, is charged in a three count Superseding Indictment with conspiracy to distribute a controlled substance, possession with intent to distribute a controlled substance both occurring on or about August 13, 2009 and illegal reentry into the United States on or about November 29, 2010. These charges were filed as the result of an investigation by the Drug Enforcement Administration. This case has been assigned to and will be prosecuted by Assistant United States Attorney Robert N. Trgovich.

 

Miguel Hernandez-Rivera, a/k/a Noe Hernandez-Montoya, a/k/a Noe Hernandez-Rivera, 30, is charged in a single count Indictment with illegal reentry into the United States on or about November 20, 2010. This charge was filed as the Immigration Customs Enforcement. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller.

 

Roberto Montemayor, Jr., 27, of Marion, Indiana and Darol Leon Floyd, 47, of Hartford City, Indiana, are charged in a single count Indictment with possession with the intent to distribute a controlled substance on or about December 8, 2010. The Indictment also seeks for the forfeiture of U.S. currency. This charge was filed as the result of an investigation by the Immigration Customs Enforcement, Drug Enforcement Administration, Indiana State Police, Joint Effort Against Narcotics (JEAN) Task Force, Blackford County Sheriff’s Office, Grant County Sheriff’s Office, and the Marion Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Anthony W. Geller.

 

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

 

The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
