ACTIVITY IN FEDERAL COURT - HAMMOND
Hammond, Indiana—The United States Attorney's Office announced the following indictments returned in federal court:
Noe Diaz, 30, and Alfredo Delgado, 30, both of Chicago, Illinois, were charged in an eight count indictment returned today with drug trafficking. Delgado and Diaz were each charged with 1count of possession with the intent to distribute cocaine and methamphetamine. Delgado was also charged with 3 additional counts of possession with the intent to distribute cocaine, and 2 additional counts of possession with the intent to distribute methamphetamine. Diaz was charged with 1 additional count of possession with the intent to distribute cocaine, and 1 additional count of possession with the intent to distribute methamphetamine. This case is being investigated by the Drug Enforcement Administration HIDTA Task Force, and is being prosecuted by Assistant United States Attorney David Nozick.
Juan Perez-Rogelio, 22, of Chicago, Illinois, was charged in an indictment returned on September 1, 2010, with 1 count of distribution of cocaine, and 1 count of eluding examination and inspection by immigration officers while remaining in the United States. Perez-Rogelio is a citizen of Mexico. These charges were filed as the result of an investigation by the Drug Enforcement Administration, and U.S. Immigration and Customs Enforcement. This case has been assigned to and will be prosecuted by Assistant United States Attorney Joshua Kolar.
Nigle Mays, 33, of the 1600 block of West 39th Court, Gary, Indiana, was charged in an indictment returned on September 1, 2010, with 1count of receipt of child pornography, and 1 count of possession of child pornography. These charges were filed as the result of an investigation by U.S. Immigration and Customs Enforcement, the Indiana State Police, and the Carmel, Indiana Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Jill Trumbull-Harris.
The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
