FEDERAL GRAND JURY IN FORT WAYNE RETURNS INDICTMENTS


Fort Wayne, IN—The United States Attorney's Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following Indictments on September 22, 2010:

 

JONATHAN DAVIS, age 18, of Delta, Ohio, is charged in a two count Indictment armed robbery of a controlled substance on or about August 15 and August 18, 2010. These charges were filed as the result of an investigation by the Northeast Indiana Federal Bank Robbery Task Force, Ashley Police Department and the Ligonier Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

 

JOSIAH A. DAVIS, age 26, of Ashley, Indiana, is charged in a two count Indictment with unlawful possession of a firearm while being a user of or addicted to any controlled substance on or about August 22, 2010, and possession with the intent to distribute a controlled substance on or about August 25, 2010. These charges were filed as the result of an investigation by the Northeast Indiana Federal Bank Robbery Task Force, Ashley Police Department and the Ligonier Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

 

NATHAN T. PEREZ, age 23, of Fort Wayne, Indiana, is charged in a single Indictment with robbery of a controlled substance on or about September 12, 2010. This charge was filed as the result of an investigation by the Northeast Indiana Federal Bank Robbery Task Force. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

 

ROBERT L. PRICE, JR., age 31, of Fort Wayne, Indiana, is charged in a single count Indictment with possess with the intent to distribute a controlled substance on or about September 2, 2010. This charge was filed as the result of an investigation by the Drug Enforcement Administration and the Fort Wayne Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lesley J. Miller Lowery.

 

JORGE ROSAS, aka Jorge Rosas-Viveros, age 36, BEATRIZ BOJORQUEZ, age 32, BENJAMIN A. VANALLEN, age 31, and ADRIAN A. JUAREZ, age 35, all of Fort Wayne, Indiana are charged in a Superseding Indictment as follows: Rosas is charged with conspiracy to distribute and possession with the intent to distribute methamphetamine from on or about September 10, 2009, and continuing until on or about September 1, 2010; distribution of controlled substances on September 10, 2009, October 20, 2009, December 17, 2009, January 14, 2010, and April 12, 2010, and possession of a firearm in furtherance of a drug trafficking crime from on or about September 10, 2009, and on or about September 1, 2010. Bojorquez is charged with conspiracy to distribute and possession with the intent to distribute methamphetamine from on or about September 10, 2009, and continuing until on or about September 1, 2010, and maintaining a drug residence from on or about September 10, 2009, to on or about September 1, 2010. VanAllen is charged with conspiracy to distribute and possession with the intent to distribute methamphetamine from on or about September 10, 2009, and continuing until on or about September 1, 2010, maintaining a drug residence from on or about June 4, 2010, to on or about September 1, 2010, and possession with intent to distribute a controlled substance on or about September 1, 2010. Juarez is charged with conspiracy to distribute and possession with the intent to distribute methamphetamine from on or about September 10, 2009, and continuing until on or about September 1, 2010. The Superseding Indictment also seeks the forfeiture of vehicles and U.S. currency. These charges were filed as the result of an investigation by the Federal Bureau of Investigation, Gang and Narcotics Enforcement Team, Indiana State Police, Allen County Police Department, and the Fort Wayne Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorneys Anthony W. Geller and Tina L. Nommay.

 

The specific sentence in each case to be imposed upon conviction will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

 

The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
