FEDERAL GRAND JURY IN FORT WAYNE RETURNS INDICTMENTS

Fort Wayne, INCThe United States Attorney's Office announced that a Grand Jury sitting in Fort Wayne, Indiana, returned the following Indictments on December 18, 2012:
Michael A. Banks, 22, of Fort Wayne, Indiana, is charged in a three count Superseding Indictment with possession with the intent to distribute MDPV, possession of a firearm in furtherance of a drug trafficking crime, and being a felon in possession of a firearm, all occurring on or about August 10, 2012. These charges were filed as a result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, and the Fort Wayne Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Lovita Morris King.
Brenton Ennis, 18, of Fort Wayne, Indiana, and Craig Whigum, 19, of Fort Wayne, Indiana are charged in a two count Indictment with interference with commerce by threat or violence and use, carry, brandish, and discharge a firearm during and in relation to a crime of violence both occurring on or about November 13, 2012. These charges were filed as a result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives, Fort Wayne Police Department, Allen County Police Department and the New Haven Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Tina L. Nommay.
Pedro Garza, 31, of Fort Wayne, Indiana, and Luis Juarez-Cabrera, 31, of Warsaw, Indiana, are charged in a five count Indictment respectively. Garza is charged in all five counts with three counts of distribution of cocaine on or about November 7, November 19 and November
27, 2012. Both Garza and Juarez-Cabrera are charged with distribution of marijuana and cocaine on or about December 3, 2012, and possession with intent to distribute cocaine on or about December 11, 2012. These charges were filed as a result of an investigation by the Drug Enforcement Administration and the Fort Wayne Police Department. This case has been assigned to and will be prosecuted by Assistant United States Attorney Tina L. Nommay.
The United States Attorney's Office emphasized that an Indictment is merely an allegation and that all persons charged are presumed innocent until and unless proven guilty in court.
If convicted in court, any specific sentence to be imposed will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.
