WEEK IN REVIEW – SOUTH BEND

 

 

            South Bend, Indiana —The United States Attorney’s Office announced the following activity in Federal Court:

 

PLEAS:

 

Ø  Sylvester Mayes, 29, of Midwest City, Oklahoma, pled guilty before Magistrate Judge Christopher A. Nuechterlein to the felony offense of knowingly and intentionally distributing a mixture or substance containing a detectable amount of cocaine base (“Crack”). Magistrate Nuechterlein is recommending that the district court accept the tendered guilty plea.  Parties have 10 days in which to object to the magistrate judge’s recommendation. Sentencing has been set for 9/16/2013 9:00 AM before District Judge Robert L. Miller Jr. This charge was filed as a result of an investigation by the Drug Enforcement Agency.  This case is being prosecuted by Assistant United States Attorney Frank Schaffer.

 

 

Ø  Ricky Ruiz, 36, of LaPorte, Indiana, pled guilty before Magistrate Judge Christopher A. Nuechterlein to the felony offense of knowingly or intentionally distributing a mixture or substance containing cocaine. Magistrate Nuechterlein is recommending that the district court accept the tendered guilty plea.  Parties have 10 days in which to object to the magistrate judge’s recommendation. This charge was filed as a result of an investigation by the Drug Enforcement Agency.  This case is being prosecuted by Assistant United States Attorney Frank Schaffer.

 

Ø  Jose Martinez, 38, of Crown Point, Indiana, pled guilty before Magistrate Judge Christopher A. Nuechterlein to the felony offense of knowingly and intentionally possessing with the intent to distribute a mixture or substance containing a detectable amount of cocaine. Magistrate Nuechterlein is recommending that the district court accept the tendered guilty plea.  Parties have 10 days in which to object to the magistrate judge’s recommendation. Sentencing set for 9/16/2013 9:00 AM before District Judge Robert L. Miller Jr.  This charge was filed as a result of an investigation by the Drug Enforcement Agency.  This case is being prosecuted by Assistant United States Attorney Frank Schaffer.

 

 


 

 

 

 

If convicted in court, any specific sentence to be imposed will be determined by the judge after a consideration of federal sentencing statutes and the Federal Sentencing Guidelines.

 

DISPOSITION:

 

 

Ø  Jeffrey Alan Sheppard, 21, of South Bend, Indiana, was sentenced by District Judge Robert L. Miller to serve 72 months imprisonment and 4 years supervised release after pleading guilty to the felony offense of carrying a firearm during a drug trafficking crime/crime of violence.  According to documents filed, Sheppard was involved in a home invasion in which a man was shot and a pound of marijuana was stolen.  This case was the result of an investigation by the Bureau of Alcohol, Tobacco, Firearms and Explosives.  This case was prosecuted by Assistant United States Attorney Donald Schmid.
