TWO MEN INDICTED FOR ASSAULTING FEDERAL AGENT DURING SHOOTING INCIDENT IN TOPEKA

TOPEKA, KAN. – Two Topeka men involved in a shooting incident last month at a Topeka motel have been indicted on charges of assaulting a federal agent, Acting U.S. Attorney Marietta Parker said today.

Antoine Cardin Williams, 28, Topeka, Kan., and Phillip Tyrone Williams, 34, Topeka, Kan., are charged with one count of distributing crack cocaine, two counts of assaulting an agent of the Bureau of Alcohol, Tobacco, Firearms and Explosives, one count of robbing a federal agent of a firearm, three counts of brandishing firearms in furtherance of a crime of violence, and one count of unlawful possession of firearms after felony convictions. The crimes are alleged to have occurred March 26, 2009, in Shawnee County, Kan.

Antoine Cardin Williams was shot and wounded in the incident, which took place at a hotel in the 1200 block of S.W. Wanamaker in Topeka.

According to the indictment, the two defendants assaulted an ATF agent who was in the performance of his duties by striking him with a fist, pointing a gun at him and forcibly taking his gun.

If convicted, they face a maximum penalty of 20 years and a fine up to $1 million on the drug charge, a maximum penalty of 20 years and a fine up to $250,00 on each of the counts of assaulting a federal agent, a maximum penalty of 15 years and a fine up to $250,000 on the charge of robbing a federal agent at gunpoint, a penalty of not less than 7 years and not more than life on each count of brandishing a firearm in furtherance of a crime of violence, and a maximum penalty of 10 years and a fine up to $250,000 on the charge of unlawful possession of a firearm. The Topeka Police Department, the Bureau of Alcohol, Tobacco, Firearms and Tobacco and the Shawnee County District Attorney’s office worked on the investigation. Assistant U.S. Attorney Randy Hendershot is prosecuting.

As in any criminal case, a person is presumed innocent until and unless proven guilty. The indictments filed merely contain allegations of criminal conduct.
