HENDERSON MAN PLEADS GUILTY TO RECEIVING CHILD PORNOGRAPHY
OWENSBORO, KY - James McGan, age 62, of Henderson, Kentucky, in Henderson County, pled guilty to receiving child pornography, U.S. Attorney David L. Huber of the Western District of Kentucky announced today.
McGan admitted that on or about October 4, 2006, he received in interstate commerce, via a computer over the internet, a visual depiction, the production of which involved the use of a minor engaging in sexually explicit conduct.
A search warrant that was executed by agents with the U.S. Immigration and Customs Enforcement at McGan’s residence on November 30, 2007, after he was identified as someone who may have purchased child pornography online from websites, revealed the following images:
• Image 1 depicting two minor females, approximately seven to thirteen years of age, performing oral sex on an adult male penis. One of the minor females has the erect penis in her mouth while the other appears to be kissing the base or scrotum of the penis.
• Image 2 depicting a minor female, approximately six-eleven years of age, posed with her legs spread exposing her genitalia.
• Image 3 depicting a minor female, approximately six-eleven years of age, posed with her legs spread exposing her genitalia.
McGan confirmed he had used a website to pay for online purchases. McGan was identified as a subject in a nationwide investigation by the U.S. Immigration and Customs Enforcement into online purchases of child pornography. After McGan's computer was seized at the search, ICE conducted a forensic analysis of the hard disk drive from his computer. The analysis revealed numerous child pornographic files on McGan's computers.
Following entry of his guilty plea, McGan was ordered detained in federal custody pending imposition of sentence. The minimum potential penalties are 5 years imprisonment, and supervised release for a period of 5 years. The maximum potential penalties are not more than 20 years imprisonment, a $250,000 fine, and supervised release for up to life.
The case is being prosecuted by Madison T. Sewell, Assistant United States Attorney, and it was investigated by the Department of Homeland Security, Immigration and Custom Enforcement.
The plea was entered before Joseph H. McKinley, Jr., Judge, United States District Court, Owensboro, Kentucky.
McGan is scheduled to be sentenced before Judge McKinley on July 11, 2008, at 9:00 a.m. in Owensboro, Kentucky.
