LAGRANGE MAN SENTENCED TO SIX YEARS AND SIX MONTHS FOR RECEIPT AND POSSESSION OF CHILD PORNOGRAPHY
– Defendant purchased subscriptions to child pornography Web sites

LOUISVILLE, KY - Tony Delano, age 38, of LaGrange, Kentucky, in Oldham County, was sentenced to 6 years and 6 months imprisonment in United States District Court, Louisville, Kentucky, for receiving and possessing child pornography, U.S. Attorney David L. Huber announced today. Joseph H. McKinley, Jr., Judge, United States District Court, also sentenced Delano to 5 years supervised release following incarceration. There is no parole in the federal judicial system.

Delano’s activities were discovered as a result of a multi-agency investigation in New Jersey of Regpay, a third-party billing and credit card aggregating company that conspired with other website operators to commercially distribute child pornography by providing other websites with billing and credit card aggregating services, in return taking a percentage of the other websites’ illegal proceeds. The investigation also revealed that Regpay itself operated several websites that sold child pornography. After analyzing the customer data, ICE forensic agents identified over ten thousand purchases of child pornography associated with those websites, specifically over ten thousand confirmed subscriptions which granted purchasers access to those websites and to receive child pornography from those websites between January and July of 2003. One of these subscribers was Tony Delano who had purchased four subscriptions to the child pornography website.

Thereafter, law enforcement officials interviewed Delano at his home and seized three computers with downloaded child pornography. The images found included depictions of: a 5 – 9 year old girl lying on a bed on her stomach holding an adult male penis to her open mouth; an adult male penis ejaculating on the face of an infant girl approximately 12 - 18 months years of age; and an adult male inserting his penis into the mouth of a 5 – 9 year old girl sitting on a bed.

This case was brought as part of Project Safe Childhood, a nationwide initiative designed to protect children from online exploitation and abuse. Led by the United States Attorney’s Offices, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as identify and rescue victims. The case was prosecuted by Assistant United States Attorney Ann Claire Phillips and was investigated by the Department of Homeland Security, Immigration and Customs Enforcement (ICE).
