FORMER LABORER PLEADS GUILTY

LOUISVILLE, KY - David Lee Tungett, age 37, of Hudson, Kentucky, in Hardin County, was charged and plead guilty to withholding and destroying expense invoices required to be kept by a Labor Union, in violation of 29 U.S.C. §439(c), Acting United States Attorney Candace G. Hill of the Western District of Kentucky announced today.

The Information, which charges a Class A Misdemeanor, alleges that on or about March 28, 2006, Tungett withheld receipts for cash withdrawals he made on credit cards associated with his employment with Kentucky Laborers District Counsel, No. 210, Lawrenceburg, Kentucky. At the time of the offense, Tungett traveled for the Union and lived in Louisville, Kentucky.

The maximum potential penalties are 1 year imprisonment, a $100,000 fine, and supervised release for a period of 1 year. Tungett cannot hold Union office for 13 years after being sentenced.

The case is being prosecuted by Assistant United States Attorney Randy Ream, and it was investigated by the U.S. Department of Labor, Office of Labor Management Standards.

Tungett is scheduled to appear for sentencing before the United States Magistrate Judge Dave Whalin on November 6, 2009, at 10:00 a.m., in Louisville, Kentucky.
