MEXICAN NATIONAL CHARGED WITH MAKING FALSE STATEMENT ON PASSPORT APPLICATION AND MAKING FALSE CLAIM OF U.S. CITIZENSHIP

PADUCAH, KY - A federal grand jury in Paducah returned an indictment on September 15, 2009, against Domingo Lemus Pahuamba, age 29, of Mexico, on charges of making a false statement in application for a passport and making a false claim of U.S. citizenship, United States Attorney Candace G. Hill of the Western District of Kentucky announced today.

The Indictment alleges that Domingo Lemmus Pahuamba, a citizen of Mexico, made a false statement in an application for a passport and stated that his name was that of another, which statement he knew to be false. The Indictment also alleges that Pahuamba falsely and willfully represented himself to be a citizen of the United States.

According to the criminal complaint that was filed in this case on or about September 8, 2009, Domingo Lemus Pahuamba (Pahuamba) identified himself as another individual and executed a DS-11 Application for United States Passport at a United States Post Office in Paducah, Kentucky on April 11, 2008. As proof of citizenship, Pahuamba presented a State of Texas birth certificate, in the name of another individual and as proof of identity, Pahuamba presented a Kentucky driver’s license, also in the name of the other person.

In the event of a conviction, the maximum potential penalties are 10 years’ imprisonment, a $250,000 fine, and supervised release for a period of 3 years.

The case is being prosecuted by Assistant United States Attorney Michele Thielhorn, and it was investigated by the United States Department of State, Diplomatic Security Service.

Pahuamba is scheduled to appear for arraignment before the United States Magistrate Judge on October 14, 2009, at 1:30 p.m. in Paducah, Kentucky.

The indictment of a person by a Grand Jury is an accusation
only and that person is presumed innocent until and unless
proven guilty.
