ILLEGAL ALIENS INDICTED FOR UNLAWFUL RE-ENTRY

LOUISVILLE, KY - A federal grand jury in Louisville returned an indictment against David Martinez-Sanchez and Baltazar Gonzalez-Acuna, both Mexican nationals, on charges that they are both aliens present in the United States after having been previously removed from the United States, U.S. Attorney Candace G. Hill of the Western District of Kentucky announced today.

The Indictment follows the arrest of Martinez-Sanchez and Gonzalez-Acuna pursuant to the issuance of a federal complaint. The complaint alleged that on September 2, 2009 both defendants were stopped by Louisville Metro Police for a traffic violation. A check of Martinez-Sanchez’s identification revealed that he had previously been deported from the United States on June 30, 2009. A check of Gonzalez-Acuna’s identification revealed that he had previously been deported from the United States on June 21, 1993. At the time of the stop, neither defendant had obtained permission from the Secretary of the Department of Homeland Security to re-enter the United States.

In the event of a conviction, the maximum potential penalties are no more than 20 years imprisonment, a $250,000 fine, and supervised release for a period of 3 years. There is no parole in the federal judicial system.

The case is being prosecuted by Assistant United States Attorney Mac Shannon, and it was investigated by Bureau of Immigration and Customs Enforcement (ICE) and Louisville Metro Police (LMPD).

Both Defendants are scheduled to appear for arraignment before the United States Magistrate Judge on October 22, 2009 at 9:00 a.m., in Louisville, Kentucky.
