BOWLING GREEN MAN PLEADS TO FEDERAL NARCOTICS VIOLATIONS
– Bowling Green man pleads guilty to trafficking in crack cocaine

BOWLING GREEN, KY - On October 7, 2009 Robert Deshawn Boyd, Jr., age 29, of Horse Cave Kentucky, entered a guilty plea before Magistrate Judge E. Robert Goebel to the charge of possession with intent to distribute crack cocaine, United States Attorney, Candace G. Hill, Western District of Kentucky, announced today.

Pursuant to a plea agreement, Boyd admitted that on October 31, 2008, in Warren County, Kentucky he possessed with the intent to distribute five grams or more of crack cocaine. On October 30, 2008, in the Western District of Kentucky, Warren County, WCDTF officers, using a Confidential Source, arranged to purchase an ounce of crack cocaine from Boyd. When Boyd was located at the meeting place, Greenwood Mall, he was arrested on an outstanding state warrant prior to completion of the drug deal. A trained narcotics dog hit on the Boyd’s vehicle indicating narcotics and a state search warrant was obtained to search the vehicle. Approximately 66.1 g of suspected crack cocaine, packaged in two separate bags, was recovered from the vehicle. Also recovered from the vehicle were various items of paperwork and writings belonging to the Boyd. At the time of his arrest, Boyd admitted that not all of the seized crack was real. A field test resulted in a positive hit for only one bag. Laboratory testing by the Kentucky State Police confirmed that 26.174g was in fact cocaine base, while 37.261g failed to test positive for any controlled substance. On March 22, 2005, Boyd was convicted of six separate counts trafficking in a controlled substance I (Cocaine), under Barren County Circuit Court Indictments 03-CR-31, 03-CR-165, 03-CR-435, 04-CR-315, 04-CR-302, and 04-CR-473.

The maximum potential penalties are no more than 40 years’ imprisonment, a fine of $2,000,000.00, and supervised release for a period of life, and the minimum potential penalties are 5 years’ imprisonment and no less than 4 years’ supervised release. There is no parole in the Federal Judicial system.

The case is being prosecuted by Assistant United States Attorney Mac Shannon. The case was investigated by the Bowling Green/Warren County Drug Task Force.

Boyd is scheduled to be sentenced before District Judge Thomas B. Russell on January 5, 2010, at 11:30 a.m., in Bowling Green, Kentucky.
