SUPERSEDING DRUG INDICTMENT FOR ILLEGAL ALIEN PREVIOUSLY INDICTED FOR UNLAWFUL RE-ENTRY

LOUISVILLE, KY - A federal grand jury in Louisville, returned a superseding indictment against David Martinez-Sanchez, a Mexican national, adding a charge that he possessed with the intent to distribute cocaine, in addition to his previous charge of being an alien present in the United States after having been previously removed from the United States United States, U.S. Attorney Candace G. Hill of the Western District of Kentucky announced today.

The superseding Indictment alleges that on or about September 2, 2009, in Jefferson County, Kentucky, Martinez-Sanchez possessed with the intent to distribute 500 grams or more of cocaine. The superseding indictment follows Martinez-Sanchez’s arrest, pursuant to the issuance of a federal complaint, relating to immigration law violations. The complaint, and initial indictment, alleged that on September 2, 2009 the defendant was stopped by Louisville Metro Police for a traffic violation. A check of Martinez-Sanchez’s identification revealed that he had previously been deported from the United States on June 30, 2009. At the time of the stop, the defendant had not obtained permission from the Secretary of the Department of Homeland Security to re-enter the United States.

In the event of a conviction, the maximum potential penalties are no more than 60 years’ imprisonment, a $2,250,000 fine, and supervised release for a period of up to life. There is no parole in the federal judicial system.

The case is being prosecuted by Assistant United States Attorney Mac Shannon, and it was investigated by Bureau of Immigration and Customs Enforcement (ICE) and Louisville Metro Police Department (LMPD).

Martinez-Sanchez is scheduled to appear for arraignment before the United States Magistrate Judge on December 22, 2009, at 9:00 a.m., in Louisville, Kentucky.

only and that person is presumed innocent until and unless
proven guilty.
