CONVICTED FELON PLEADS GUILTY TO FEDERAL GUN CHARGES

JERMAINE A. HULBERT, age 28, a resident of New Orleans, Louisiana, pled guilty today before the U. S. District Judge Mary Ann Vial Lemmon to two counts of possession of a firearm by a convicted felon, announced U. S. Attorney Jim Letten.
According to the factual basis, on July 30, 2007, New Orleans Police Officers, while on routine patrol, observed the defendant HULBERT standing in the street and grasping the right side of his waistband in a manner that arose the officers’ suspicions. When the officers proceeded to investigate further, HULBERT attempted to fleet. After a brief chase and subsequent struggle, officers discovered a semi-automatic pistol, fully-loaded with hollow-point bullets, in HUBLERT waistband.
Also according to factual basis, on Sunday, February 17, 2008, while investigating a report of a fight, New Orleans Police Officers observed four subjects attempting to enter a vehicle and drive away from the scene. When officers stopped the vehicle, HULBERT, attempting to flee, exited the rear passenger door while holding a firearm. The officers apprehended HULBERT after a brief chase and struggle. Officers recovered a .40 caliber semi-automatic pistol, loaded with twenty-six (26) rounds of live ammunition.
Subsequent investigation revealed that HULBERT previously had been convicted on September 17, 1999 of possession of cocaine, and on September 9, 2002 of aggravated battery, both in Orleans Parish Court
For each charge, HULBERT faces a maximum term of imprisonment of twenty (20) years, a maximum fine of the greater of $250,000, and up to three (3) years of supervised release following any term of imprisonment. Sentencing has been scheduled for September 3, 2008.
This investigation was conducted by the New Orleans Police Department, with the assistance of the Bureau of Alcohol, Tobacco, Firearms and Explosives. The case is being prosecuted by Assistant U. S. Attorney Christopher Cox of the Violent Crime Unit.
