FRANKLINTON MAN SENTENCED TO 15 YEARS IN FEDERAL PRISON FOR GUN VIOLATION
November 5, 2008
FOR IMMEDIATE RELEASE
RECHARD D. YOUNG, 29, of Franklinton, was sentenced by U. S. District Judge Eldon Fallon to fifteen (15) years (180 months) imprisonment for possessing a firearm as a convicted felon, announced U. S Attorney Jim Letten. Judge Fallon found that YOUNG qualified for a sentencing enhancement as an Armed Career Criminal in determining the sentence. In addition to the term of imprisonment, Judge Fallon imposed five (5) years of supervised release following the term of imprisonment during which time, the defendant will be under federal supervision and risks an additional term of imprisonment should he violate any terms of his supervised release.
On August 6, 2008, YOUNG pled guilty to charges before Judge Fallon admitting that on December 14, 2007, he was in possession of a Smith and Wesson .38 caliber revolver when he was stopped and arrested by Franklinton Police Officers. YOUNG, who was previously convicted for three counts of Distribution of Cocaine in the 22nd Judicial District Court in December, 1998 and aggravated assault with a firearm in Orleans Parish in 1997, was prohibited by federal law from possessing a firearm.
The Court imposed a sentence that was within the recommended guidelines range. After sentencing, YOUNG was remanded to the custody of the United States Marshal’s Service to begin his term of imprisonment.
This investigation was handled by Special Agents of the Bureau of Alcohol, Tobacco, Firearms and Explosives along with the officers of the Franklinton Police Department. The case was prosecuted by Assistant United States Attorneys Abe McGull and Edward J. Rivera pursuant to the Department of Justice’s Project Safe Neighborhoods program.
