ALIEN INDICTED ON ONE COUNT OF ILLEGAL RE-ENTRY

FOR IMMEDIATE RELEASE

IGNACIO MAGANA-MENDOZA, age 37, a resident of Mexico, was charged in a one-count indictment by a Federal Grand Jury for illegal re-entry by an alien previously deported, announced U. S. Attorney Jim Letten.

According to the indictment, on or about October 5, 2008, IGNACIO MAGANA-MENDOZA, an alien who had previously been removed and deported from the United States, was found in the United States within the Eastern District of Louisiana, without having obtained consent from the Secretary of the Department of Homeland Security to reapply for admission to the United States. It is also alleged that IGNACIO MAGANA-MENDOZA has been previously convicted of a felony.

If convicted, IGNACIO MAGANA-MENDOZA faces a maximum term of imprisonment of ten years, a fine of $250,000.00, three years of supervised release following any term of imprisonment, and a $100.00 special assessment.

U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by the United States Immigration and Customs Enforcement. The case is being prosecuted by Assistant U. S. Attorney Matt Chester.
