ILLEGAL ALIEN PLEADS GUILTY IN FEDERAL COURT

December 17, 2008

FOR IMMEDIATE RELEASE

IGNACIO MAGANA-MENDOZA, age 37, a resident of Mexico, pled guilty to one-count of illegal re-entry by a deported alien before U.S. District Judge Ivan L.R. Lemelle, announced U. S. Attorney Jim Letten.

According to the factual basis, IGNACIO MAGANA-MENDOZA admitted that he was alien who was previously deported and was knowingly and unlawfully found in the United States in Orleans Parish, Louisiana, without the Secretary of the Department of Homeland Security having expressly consented to his re-application for admission into the United States.

The indictment charging IGNACIO MAGANA-MENDOZA with one count of illegal reentry of deported alien also included a notice of sentencing enhancement based on MAGANA-MENDOZA’s prior felony conviction. With the enhancement, the single count carries a maximum statutory penalty of ten years imprisonment. Sentencing has been scheduled for March 11, 2009.

The case was investigated by United States Immigration and Customs Enforcement. The prosecution was handled by Assistant U. S. Attorney Matt Chester.
