LOCAL WOMAN CHARGED WITH SOCIAL SECURITY FRAUD

FOR IMMEDIATE RELEASE

KIMBRA M. WHITTEY, age 42, a resident of New Orleans, Louisiana, was charged in a one-count bill of information with making false statements to the United States, announced U.S. Attorney Jim Letten.

According to the bill of information, on or about December 2, 2008, WHITTEY made a false statement as to a material fact regarding her work status in information provided to the Social Security Administration. Specifically, on Form SSA 454-BK, WHITTEY, falsely claimed she had not worked since the date of her last medical disability decision, when in fact, she had worked. This false statement resulted in an overpayment of Social Security disability payments to WHITTEY.

If convicted, WHITTEY faces a maximum sentence of five years in prison, a $250,000.00 fine, and a three (3) year term of supervised release following any term of imprisonment.

The case was investigated by the Special Agent Alan Huynh, Social Security Administration/Office of Inspector General/Office of Investigations.

U. S. Attorney Letten reiterated that a bill of information is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case is being prosecuted by Assistant U. S. Attorney Irene González.
