EMERGENCY ROOM DOCTOR CHARGED WITH FAILURE TO FILE TAXES

June 24, 2009

FOR IMMEDIATE RELEASE

BLAINEY J. NICHOLAS, age 42, a resident of New Orleans, Louisiana, was charged in a one-count bill of information for failure to file a tax return, announced U. S. Attorney Jim Letten.

According to court documents, during the 2002 tax year, NICHOLAS received gross income which exceeded the statutory amounts and failed to file a tax return with the Internal Revenue Service, on or before April 15, 2003.

If convicted, NICHOLAS faces a maximum term of imprisonment of one (1) year, a fine of $25,000.00 and one (1) year of supervised release following any term of imprisonment. Letten reiterated that the bill of information is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

The case was investigated by the Special Agents of the Internal Revenue Service, Criminal Investigations. The prosecution is being handled by Assistant United States Attorney Jon Maestri.
