NEW ORLEANS MAN PLEADS GUILTY TO FEDERAL GUN VIOLATION

MARCELLUS ESTEVES III, age 31, a resident of New Orleans, Louisiana, pled guilty in federal court today before U. S. District Judge Martin L. C. Feldman to being a convicted felon in possession of a firearm, announced U. S. Attorney Jim Letten.

According to court documents, ESTEVES admitted that on March 30, 2009, he went to Academy Sports & Outdoors located in Harahan, Louisiana, made a false written statement indicating that he had never been convicted in any court of a felony and purchased a Glock Model 27, .40 caliber pistol. The defendant took possession of the gun on April 5, 2009. A subsequent criminal history revealed that ESTEVES was convicted on November 23, 2004 in Orleans Parish Criminal District Court for possession of crack cocaine, battery on a police officer, and aggravated assault on a police officer with a firearm.

ESTEVES now faces a maximum term of imprisonment of ten (10) years, a fine of up to $250,000 and a maximum of three (3) years of supervised release following any term of imprisonment. He is scheduled to be sentenced by U.S. District Judge Martin L. C. Feldman on October 22, 2009 at 10:30 A.M.

The case was investigated by Special Agents of the Bureau of Alcohol, Tobacco, Firearms and Explosives and New Orleans Police Officer. It is being prosecuted by Assistant U. S. Attorney Christopher Cox of the Violent Crime Unit.
