ALIEN INDICTED ON ONE COUNT OF ILLEGAL RE-ENTRY

FOR IMMEDIATE RELEASE
MARIO AVILA-VASQUEZ, age 29, a resident of Honduras, was charged in a one-count indictment by a Federal Grand Jury for illegal re-entry by an alien previously removed, announced U. S. Attorney Jim Letten.
According to the indictment, on October 3, 2009, AVILA is an alien who had previously been removed and deported from the United States and was found in the United States without having obtained the proper consent. The indictment also alleges that the defendant has a prior felony conviction.
If convicted, AVILA faces a possible maximum sentence of twenty (20) years imprisonment, a fine of $250,000 and three (3) years of supervised release following any term of imprisonment.
U. S. Attorney Letten reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.
The case was investigated by Immigration and Customs Enforcement. The case is being prosecuted by Special Assistant U. S. Attorney Robert Weir.
