CHELSEA MAN SENTENCED FOR ILLEGAL REENTRY AFTER REMOVAL

BOSTON, MA - A Chelsea man was sentenced late yesterday in federal court for illegally reentering the United States after he had been removed for committing a crime of violence.

Acting United States Attorney Michael K. Loucks and Bruce M. Foucart, Special Agent in Charge of Immigration and Customs Enforcement Office of Investigations - Boston Field Division, announced that on October 22, 2009 CARLOS GUEVARA, age 27, of Chelsea, Massachusetts, was sentenced by U.S. District Judge Patti B. Saris to 46 months imprisonment, to be followed by 3 years of supervised release.

At the earlier plea hearing, the prosecutor told the Court that had the case proceeded to trial the Government’s evidence would have proven that GUEVARA was arrested in Boston by Immigration and Customs Enforcement on October 29, 2008 . A fingerprint comparison revealed that GUEVARA, a native and citizen of El Salvador, had previously been removed from the United States in 2003 after being convicted in Massachusetts of Assault and Battery with a Dangerous Weapon. GUEVARA returned to the United States without permission in 2007, which led to his eventual arrest and prosecution in this case.

The case was investigated by Immigration and Customs Enforcement. It was prosecuted by Special Assistant U.S. Attorney Michael Brennan of Loucks’ Major Crimes Unit.
