HEROIN DEALER SENTENCED TO 15 YEARS IN PRISON
Baltimore, Maryland - U.S. District Judge J. Frederick Motz sentenced Gerald Gardner, age 40, of Pikesville, Maryland, today to 15 years in prison, followed by three years of supervised release, after he pleaded guilty to possession with intent to distribute heroin. Judge Motz also entered a forfeiture order against Gardner for $4,829, the amount seized when Gardner was arrested.
The sentence was announced by United States Attorney for the District of Maryland Rod J. Rosenstein; Special Agent in Charge Ava Cooper-Davis of the Drug Enforcement Administration - Washington Field Division; and Anne Arundel County Police Chief James Teare, Sr.
According to Gardner’s guilty plea, on July 18, 2009, law enforcement officers were called to a domestic assault in progress in the 300 block of Arundel Corporation Road in Glen Burnie. When the first officer arrived at the location, he saw Gardner in his car in the parking lot out front. As the officer got out of his car, Gardner also got out and told the officer, without being questioned, that the victim was injured because she had fallen and injured her leg. After additional law enforcement arrived, they searched Gardner’s car and recovered: $4,000 in the passenger side glove box; a plastic bag containing 100 yellow capsules of heroin in the center console; and an empty tire repair cannister containing plastic bags with 233 additional capsules of heroin under the driver’s side seat. The total weight of the heroin in the 333 capsules was 76 grams. Police also recovered $829 in cash when they searched Gardner.
United States Attorney Rod J. Rosenstein commended Assistant United States Attorney Thiruvendran Vignarajah, who prosecuted the case.
