LUDINGTON AREA MAN SENTENCED TO SEVEN YEARS
ON FIREARM CHARGE RELATING TO SHOOTING INCIDENT

FRIDAY, OCTOBER 30, 2009 - GRAND RAPIDS, Mich. – Timothy Ray Palacios, age 26, of Scottville, Michigan, was sentenced to a little more than seven years (86 months) in prison following his conviction for being a felon in possession of a firearm. The charge related to a shooting incident that took place in Ludington, Michigan. The Honorable Gordon J. Quist presided over the sentencing hearing. In addition to the seven-year prison sentence, Judge Quist ordered Palacios to serve three years of court supervision following his release from prison.

The conviction stemmed from a report of shots fired on September 28, 2008, in Ludington, Michigan. After arriving on the scene, Ludington Police Officers learned that an altercation between Palacios and other individuals had escalated to the point that Palacios fired a number of shots at the other individuals. The altercation left several individuals injured, including Palacios, who was treated for a knife wound to the head. The officers arrested Palacios after retrieving a firearm and body armor he used during the incident.

A federal grand jury later charged Palacios with being a felon in possession of a firearm and with possession of body armor following a felony conviction for a crime of violence. Palacios has an extensive criminal history, including several convictions for assaulting, resisting and obstructing police officers, assault with a dangerous weapon, and narcotics violations. On April 28, 2009, Palacios pled guilty, pursuant to a plea agreement, to the felon-in-possession-of-a- firearm charge. Palacios has been held in custody since being charged in this case, and he was remanded to the custody of the U.S. Marshal to serve his sentence in the Bureau of Prisons.

The case was prosecuted under the federal Project Safe Neighborhoods initiative. U.S. Attorney Davis commended the Ludington Police Department and the Bureau of Alcohol, Tobacco and Firearms for their work on the case. Palacios was prosecuted by Assistant U.S. Attorneys Jennifer McManus, Phillip J. Green and Russell Kavalhuna.
