TWO DENT COUNTY MEN INDICTED ON ILLEGAL PRESCRIPTION DRUG CHARGES

St. Louis, MO: Thomas Dillon and John Gibbs were indicted on charges of illegal distribution of prescription drugs, United States Attorney Catherine L. Hanaway announced today.

According to the indictment, in Dent County, between February and November 2007, Dillon and Gibbs acquired Vicoprofen by fraud, and during the same dates Dillon possessed and distributed Vicoprofen (containing hydrocodone).
 
THOMAS MATTHEW DILLON, Salem, Missouri, was indicted by a federal grand jury on one felony count of possession with the intent to distribute Vicoprofen and one felony count of illegally obtaining Vicoprofen. JOHN GIBBS, Salem, Missouri, was indicted by a federal grand jury on one felony count of illegally obtaining Vicoprofen.  The grand jury returned the indictments January 29, 2009, but the indictment remained sealed until late Friday afternoon.  Dillon appeared in federal court earlier today for arraignment. Gibbs is scheduled to appear Tuesday.
                                                           
If convicted, possession with the intent to distribute Vicoprofen carries a maximum penalty of five years in prison and/or fines up to $500,000; illegally obtaining Vicoprofen carries a maximum penalty of four years prison and/or fines up to $250,000.

Hanaway commended the work performed on the case by the Dent County Prosecuting Attorney’s Office, the Salem Police Department, the Dent County Sheriff’s Department, the Missouri Highway Patrol, the South Central Drug Task Force, the Missouri Department of Health and Senior Services Bureau of Narcotics and Dangerous Drugs and Assistant United States Attorney Noelle Collins, who is handling the case for the U.S. Attorney’s Office.

The charges set forth in an indictment are merely accusations, and each defendant is presumed innocent until and unless proven guilty.
