PLEASANT HILL MAN SENTENCED FOR TAX EVASION


            KANSAS CITY, Mo. – John F. Wood, United States Attorney for the Western District of Missouri, announced that a Pleasant Hill, Mo., man was sentenced in federal court today for tax evasion.


             Terry L. Gerber, 48, of Pleasant Hill, was sentenced by U.S. District Judge Ortrie D. Smith this morning to two years and six months in federal prison without parole.


             On May 18, 2007, Gerber pleaded guilty to tax evasion. Gerber admitted that he willfully attempted to evade the income tax due for taxable income received during 2001 by failing to file an income tax return in 2002, and by utilizing domestic and foreign trusts to conceal and disguise income and assets. Gerber received taxable income of approximately $334,465 in 2001, for which he owed an income tax of approximately $135,784 (including self-employment tax).


             The total tax loss for the years 1999-2001 is $207,340, with an undetermined amount of tax loss for the years 1992 through 1998, and 2002 through 2005, when Gerber also did not file tax returns and did not pay income taxes.


            This case was prosecuted by Assistant U.S. Attorney Linda Parker Marshall. It was investigated by IRS-Criminal Investigation.
