Informational: Federal Court Arraignments

FOR IMMEDIATE RELEASE

Bill Mercer, United States Attorney for the District of Montana, announced today that during a federal court session in Great Falls, on August 28, 2009, before Senior U.S. Magistrate Judge Robert M. Holter, the following individuals were arraigned:

JORDAN CHARLES DEMONTINEY, a 22-year-old resident of Rocky Boy, appeared on a charge of second degree murder. He is currently detained. If convicted of this charge, DEMONTINEY faces possible penalties of mandatory life in prison, a $250,000 fine and 5 years supervised release. Assistant U.S. Attorney Lori Harper Suek is the prosecutor for the United States. The investigation was conducted by the Federal Bureau of Investigation.

BRIAN JAMES DAY RIDER, a 20-year-old resident of Heart Butte, appeared on a charge of assault resulting in serious bodily injury. He is currently detained. If convicted of this charge, DAY RIDER faces possible penalties of 10 years in prison, a $250,000 fine and 3 years supervised release. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was conducted the Federal Bureau of Investigation.

KATHY JEAN KELLER, a resident of Browning, appeared on a charge of assault. She is currently released on special conditions. If convicted of this charge, KELLER faces possible penalties of 6 months in prison and a $5,000 fine. Assistant U.S. Attorney Vince Carroll is the prosecutor for the United States. The investigation was a cooperative effort between the Glacier County Sheriff's Office and the Bureau of Indian Affairs.

The defendants pled not guilty to the charges.

The charge, an indictment, information or complaint, is merely an accusation and all persons named as defendants are presumed innocent until proven guilty. A pre-trial conference and a trial date will be set and the United States will be required to prove the allegations set forth in the indictment beyond a reasonable doubt.
