Frederick Clifford Demarrias, Jr. Sentenced in U.S. District Cour

The United States Attorney's Office announced that during a federal court session in Great Falls, on December 19, 2011, before U.S. District Judge Sam E. Haddon, FREDERICK CLIFFORD DEMARRIAS, JR., a 65-year-old resident of Wolf Point, appeared for sentencing. DEMARRIAS was sentenced to a term of:

Prison: 41 months

Special Assessment: $100

Supervised Release: 5 years

DEMARRIAS was sentenced in connection with his guilty plea to abusive sexual contact.

In an Offer of Proof filed by Assistant U.S. Attorney Jessica A. Betley, the government stated it would have proved at trial the following:

In June of 2010, "Jane Doe" disclosed that DEMARRIAS sexually abused her from approximately age seven to eleven at her grandmother's home. DEMARRIAS lived with "Jane Doe's" grandmother in Poplar and Wolf Point prior to her death in 2007. DEMARRIAS is an enrolled member of the Sisseton-Wahpeton Oyate, Lake Traverse Reservation in South Dakota.

Jane Doe" stayed overnight at her grandmother's house in Poplar beginning in second or third grade. She wanted to sleep with her grandmother, and on numerous occasions she slept between her grandmother and DEMARRIAS in the same bed. DEMARRIAS pulled on her underwear the first time she slept in the same bed with them, but nothing further happened. Soon after, "Jane Doe's" grandmother and DEMARRIAS moved to Wolf Point.

The first night she stayed at her grandmother's house in Wolf Point, "Jane Doe" slept in the bed between her grandmother and DEMARRIAS. That night, DEMARRIAS touched "Jane Doe" with his hands all over her body, including putting his hands inside "Jane Doe's" underwear and touching her vagina. She tried to roll away but DEMARRIAS was too strong and kept his hand inside her underwear. The touching continued numerous times and stopped when "Jane Doe" was around 10 or 11-years-old. DEMARRIAS touched her breasts, as well as put his hand on her vagina.

When questioned, DEMARRIAS confessed that when "Jane Doe" was around five-years-old he sexually abused her while she slept. On four or five occasions he came home drunk and got in bed with "Jane Doe" and her grandmother. While in bed, DEMARRIAS lifted "Jane Doe's" nightgown and fondled her vagina.

Because there is no parole in the federal system, the "truth in sentencing" guidelines mandate that DEMARRIAS will likely serve all of the time imposed by the court. In the federal system, DEMARRIAS does have the opportunity to earn a sentence reduction for "good behavior." However, this reduction will not exceed 15% of the overall sentence.

The investigation was conducted by the Fort Peck Tribes Criminal Investigation Division.
