Charles J. Fleck Sentenced in U.S. District Cour
The United States Attorney's Office announced that during a federal court session in Great Falls, on April 2, 2012, before U.S. District Judge Sam E. Haddon, CHARLES J. FLECK, a 38-year-old resident of Newman Lake, Washington, appeared for sentencing. FLECK was sentenced to a term of:
Probation: 2 years
Special Assessment: $100
FLECK was sentenced in connection with his guilty plea to misprision of a felony.
In an Offer of Proof filed by Assistant U.S. Attorney Jessica A. Betley, the government stated it would have proved at trial the following:
In December 2007, XX and ZZ stole property from in and around Great Falls, Montana. The stolen property included two 2002 Polaris snowmobiles, three saddles, four tires, a Yamaha YFZ 250 dirt bike, and a Yamaha YFZ 450 racing All Terrain Vehicle (ATV). ZZ was acquainted with FLECK, a Newman Lake, Washington man, who was willing to purchase the stolen property.
ZZ contacted FLECK and offered the vehicles for sale. On December 20, 2007, FLECK reserved and paid for a U-Haul truck rental, with a trailer, through the U-Haul call center in Spokane. The trailer was to be used to transport ZZ's Volkswagen Jetta so that he and XX would have transportation back to Great Falls after delivering the stolen property to FLECK. FLECK reserved the U-Haul for one-day with a pick-up location of Great Falls and a drop-off location of Post Falls, Idaho. ZZ and XX picked up the truck and trailer on December 20, 2007. They loaded the stolen property, and the following day, on December 21, 2010 around 2:00 a.m., left Great Falls for Newman Lake where they delivered the stolen property to FLECK, dropped off the U-Haul and headed back to Great Falls in the Jetta.
FLECK's December 20, 2007 call logs reflect four calls to numbers associated with his rental of the U-Haul. Nine calls were made to ZZ. FLECK and ZZ communicated by phone eight times the following day, December 21, 2007.
FLECK's E-bay account records indicate that FLECK began purchasing parts for the motorcycle and ATV immediately after the stolen property was delivered. FLECK bought a 2000 Yamaha YZF 250 Frame with a "clean" title on December 22, 2007, and a 2005 Yamaha YZF 450 chassis with a "clean" title on January 14, 2008.
FLECK was interviewed by the FBI and a local law enforcement officer in August, 2011. He admitted to buying stolen property from ZZ and XX, but said he may not have known the property was stolen when he first bought it but came to that conclusion soon after. In a shed on FLECK's property, the FBI found a motorcycle with the Vehicle Identification Number (VIN) filed off.
The investigation was a cooperative effort between the Great Falls Police Department and the Federal Bureau of Investigation.
