RALEIGH - United States Attorney George E. B. Holding announced that on February 13, 2007, HARVEY DELTON MINTZ, 30, of Wilmington, North Carolina was sentenced before United States District Court Terrence W. Boyle. Judge Boyle sentenced MINTZ to 180 months imprisonment and five years supervised release, $100.00 special assessment, and order MINTZ to pay $1,305.00 in restitution.
On January 17, 2006, MINTZ pleaded guilty to conspiring with others to possess with intent to distribute and to distribute more than five grams of cocaine base (crack), in violation of title 21, United States Code, Section 841(a)(1), all in violation of Title 21, United States Code, Section 846.
The government moved for an upward departure from the established advisory guideline range, arguing that MINTZ’s criminal history category did not adequately reflect the seriousness of MINTZ’s past criminal conduct or the likelihood that MINTZ would commit other crimes. Before pronouncing the sentence, the Court heard arguments from Defense and Government counsel as to the appropriate sentence and also heard victim impact statements from family members of two individuals who died of drug overdoses the Wilmington Police Department had linked to MINTZ.
Investigation of the case was conducted by the Drug Enforcement Agency and the Wilmington Police Department. Assistant United States Attorney Michael G. James handled the case for the Government.
